Laws for violence against Hospital Staff

 In India, violence against doctors/hospital Staff is a criminal offense and is punishable under several laws, including:

1.Indian Penal Code (IPC)

2. The Doctors' Protection Act, 2010

3. The Clinical Establishments (Registration and Regulation) Act, 2010


There are some laws against violence in hospitals in India, but they are not uniform or comprehensive. Violence against healthcare professionals is a common problem in India, and doctors have been demanding a specific law to protect them for many years. However, the central government has not enacted such a law, and only some states have their own laws to deal with such violence. These state laws vary in terms of the definition of violence, the punishment for the offenders, and the protection for the victims.

The only central law that addresses violence against healthcare workers is the Epidemic Diseases (Amendment) Act, 2020, which was introduced as an ordinance during the COVID-19 pandemic. This act provides that acts of violence against healthcare personnel during any situation akin to the current pandemic would be cognizable and non-bailable offences. The offenders can be punished with imprisonment for a term of three months to five years, and with fine of Rs.50,000/- to Rs.2,00,000/-. However, this act was temporary and got lapse at the end of pandemic.

Therefore, there is a need for a permanent and comprehensive law that can prevent and punish violence against healthcare workers in India. Such a law should define violence clearly and include physical, verbal, psychological, and cyber forms of violence. It should also provide adequate compensation and legal aid for the victims, and ensure speedy investigation and trial for the cases. Moreover, it should balance the rights and interests of both the healthcare workers and the patients, and not infringe on the common persons’ right to legal recourse.
